Question

If you have a deck where you keep drawing moligans are fossills considered basic?
Do you have to take the fossils in your hand or not?

Effective with the release of Legend Maker, you have to play a Fossil if it's the only "Pokemon" in your hand. You can't keep Mulliganing
 
There is no longer an optional mulligan rule for fossils. They are considered Basic Pokemon, for the purposes of starting the game.

During the game, it is only considered a Basic Pokemon while in play. (It is always considered a Trainer card, everywhere - discard pile, in play, in your hand, as well as in your deck.)
