can i choose to put nothing back into my deck (even if i have no pokemon or basic energy in the discard pile)?

If you have no pokemon or basic energy in the discard you can't use it and if you can use it and choose to you have to put at least 1 thing

I'm fairly sure that in Pokemon, "Up to X" means "At least 1, but no more than X."

No you can't fail a NM since your opponet can see what is in your discard. However you can fail a Bebe's cause your opponet doesn't know!
