If you have no pokemon or basic energy in the discard you can't use it and if you can use it and choose to you have to put at least 1 thing

I'm fairly sure that in Pokemon, "Up to X" means "At least 1, but no more than X."

No you can't fail a NM since your opponet can see what is in your discard. However you can fail a Bebe's cause your opponet doesn't know!
