Unusual Situation

I recently played a game which ended in a situation where both myself and opponent had two prizes left. We both had a Claydol sitting on the bench and not enough energy to attack in my case and enough energy on his Gardy LvL X to Bring Down (but the weakest Poke was his Claydol), no energy remaining in either of our decks nor anyway of getting energy out off our discard piles. With Cosmic Power, neither of us were going to deck-out, so in essence this was a complete stalemate.

If this situation occurred in tournament play would the correct action be to scoop, shuffle and redeal and play sudden death once time had expired?

Yes, once time has expired, Sudden Death would be the correct choice since the game would be in a perpetual stalemate.
