The fact that he acknowledges that it is fake is just so that when a parent buys it for their kid and complains, he can say "Read the small print."

He obviously is trying to rip someone off anyways. 20 bucks???

What's funny about this, is that the seller also sells other pokemon cards. Who's going to buy from him seeing he's selling any fake cards?

I know I won't be, who knows the legitimacy of any other card he's selling. If anything, he's doomed himself.

Actually because of ebay's selling policies they prohibit any sale of counterfeit merchandise even if you admit its fake doesn't take away from the fact that you are still selling a counterfeit against terms of use policy.

There is a difference between a non-tournament-legal card (such as the Worlds decks), and a complete counterfeit. His use of "not tournament legal" is obviously an attempt to conflate the two and sell the card despite its counterfeit nature.

Besides, stating it's a fake is still against eBay policy. "Disclaimers about the authenticity or legality of an item" is actually a reason you can pick for reporting a listing (although I'd still pick "Unauthorized or counterfeit trading cards").

Against ebay policy or not, all I know is I have reported a dozen of the yu-gi-oh flip a coin auctions (which IMO is 100% scamming) and I only saw one get taken done.

I actually bought an Uxie Level X on ebay a while ago from a different person and it looked exactly like this!!! although he claimed it was legit, obviously not, and that he got it from a booster pack. Still have the cards for laughs.

The yellow border is the primary tip-off. No legit LV.X has that. The reprints from the Worlds decks have a silver border (like all cards from those decks).

It's also pretty obvious even from the low-res photo that the font is wrong and the Energy symbols are bloated.

This card must be in violation of eBay's policy because it represents a violation of U.S. law. It is an obvious and unequivocal case of intellectual property theft.

The genuine version of this card has "(c)2008 Pokemon/Nintendo" printed at the bottom of it.

It is illegal to copy copyrighted designs and/or and text and then sell the item, even if you admit that it is fake and/or make minor design changes.

As far as I know, eBay does try to stay on top of these things. But PUI are the people that would probably be more interested in it.

Regardless, he doesn't even say that it's fake.

You may be reading what he said as "fake," but that's not what he said. His verbiage is clearly intended to obfuscate the card's true provenance. As ChairmanKaga pointed out, "unofficial" does not equal fake, and neither does "not tournament legal." His example of a card from the World's reprint decks is a good one to illustrate the difference between a fake and a card that's produced by PUI but is not tournament legal. That eBay seller is obviously trying to guide the buyer into assuming that this card is of similar status.
