All cards except the Ancient Mew promo and Black Star promo # 24 (_________'s Pikachu aka Happy Birthday Pikachu) are legal for DCI sanctioned play in the Unlimited format.

For the Modified format, all NEO cards (except Genesis Sneasel and Genesis Slowking), Southern Islands, Legendary Collection, E-cards (NOT the Nintendo R&S ones), Black Star promos numbered 21 and above (except # 24), and Best of Promos are legal for DCI sanctioned play.

You can check HERE! for the Pokémon Floor Rules (you will need Microsoft's Word) to see the set symbols.

Edited: Had to fix the link to the Floor RUles.

You can't use the Nintendo-produced cards in Wizards of the Coast-sponsored Organized Play...meaning, the tournaments at GenCon or any DCI-sanctioned play. The reason: WotC/DCI cannot make any rulings on these cards...so they are not legal in tourneys they sponsor. Casual play...do what you want; Leagues...it's up to the individual GL.
