Can you Pokemon Communicator for the same Pokemon?

the darkrai you just placed in the deck is a valid target (though you don't have to choose it).

You should be able to fail it, in my opinion. Consider a rescue stretcher. You can shuffle three Pokémon back into the deck before failing an ultra ball. While your opponent may be aware of the contents of your deck if they pay close attention, the GAME is unaware because your deck is not public knowledge.
