Ive always loved this franchise but with this theyve ruined their reputation, going after fan pages which are nothing but free advertisment anyway? Cause people probably wont play the games anymore after theyve seen the pictures? Or are they afraid people wont buy the games after seing the new pokemon? Thats actually quite possible but still ridiculus lol..

No pokemon black / white for me then I guess, I own every single pokemon edition (despite the internet) but it ends here, I wont support this kind of stuff :/

I also suggest to discuss this awesome ridiculous topic on other fan sites. Pokegym is obviously defending Nintendo on their move, I can tell.
 
Dogma without seeing the letter or asking the lawyer if it is copyright or trademark or both that they are pursuing there is no way to know. My own experience is that firms have moved away from using copyright towards trademarks whenever possible/practical.

Regarding not needing to pursue copyright violations that is true but what is the point of having a copyright if you don't try to get those that are breaking it to desist? It only makes sense if you intend to give the work away: to make it public domain.

I'm not defending anyone. I believe that if you create something then no one has the right to steal it.
 
Yep, that's the letter that was on Pokébeach earlier.

It's easy to know whether Pokémon games are under copyright or trademark - trademarks use TM (if registered) and copyrighted material usually has a (c).

Clearly if Nintendo feels its rights have been violated by Pokébeach/Serebii, it has a right to go after them, but at the moment we don't actually know what it is that triggered the cease and desists.

At the moment everything is speculation. (I'm not saying Nintendo is wrong, just that we honestly don't know what's going on so all we're doing is making stuff up really)
 
Meh, it's just another case of the big bad meanie trying to bully the small fansites. Sure, let's force them to take down the BW stuff and thus lose out on free advertising and such. I'm willing to bet they aren't going after anything over in Japan, where the game is released.
 
The 'free advertising' argument isn't all that strong.

1. Fansites are not doing it to give Nintendo free advertisement. They are doing it to get traffic, amongst other things.

2. Companies like to CONTROL the way their stuff is presented. I doubt Nintendo are over the moon about new Pokemon being revealed through a bunch of sprites taken off a ROM (together with a load of discussion about how lame they look) instead of with official art.

3. Do they REALLY need or want the 'free advertising' at all? Will Black and White fail miserably just cos fansites can't post their sprites? Anyone who can be bothered to go looking at Pokemon fansites is most probably going to buy the game anyway.

Note: I like seeing the stuff just as much as anyone else does, but let's not pretend these sites are trying to do Nintendo a favour.

Unless something is posted as an editorial or as a statement declaring that it is the view of the PokeGym, anything that any moderator posts as their opinion is just that: Their opinion.

Let me ask you, would you like it if someone forced you to speak for the company you work for and every sentence that comes out of your mouth must support "the company line" on every single thing that you might want to have your own thoughts and opinions on?

That would be pretty crappy of a company to force on someone, wouldn't it?

IMHO this is a bad move on Nintendo's part. Many other games have suffered by going to war with the fans that support them. It's quite simply bad business.

If the request is valid, maybe it is to keep the images protected from being used buy forgery/fake merchandise from running rampant. Nintendo may not have all of the copryrights aligned at this time to cover merchandise for here in the states- with the images being out without that protection in place, no funds for us to have events. All the fake cards, the fake plushies, ect-

If this is a hoax- wait it out.
Either way, what can we do about it technically?
 
I'm 90% sure this is a hoax. I posted a similar bit on the Black and White thread, but just to reiterate here:

Grammatical errors. Those who go to law school and go on to be hired by a company the size of Nintendo still don't know basic grammar?

24 hour notice. This plain stinks. There's no way they can legally defend any action they might have taken after only 24 hours. Even if you run a site as visited as Pokeb- Er, Pokerbeach, you can't be expected to 1. Be on within that 24 hours (But but B&W! Of course he'd be on!) 2. See the letter (little more believable, though I don't know HOW he received it. If it was by email it could easily have been overlooked/sent to Junk) 3. Respond to the letter with a WRITTEN REPLY (This is the part that gets me. Honestly, they want him to draft a response letter AND take down all the stuff that was already spread across his website within one day. :/ Really. )

Fair Use. Is it just dead? I understand that they do have the right to get him to pull anything majorly plot-related, such as pics of the encounter with Resh & Zek, but ALL the images? That stinks of wrongness. Again, a lawyer working for a company like Nintendo should be very familiar with Fair Use laws. If the letter had some thing like "Take down all images, then contact me to discuss what you can put back up" it'd be believable. But EVERY SINGLE BLACK AND WHITE IMAGE is going too far.

Then again, it IS pokebeach, they've done their own fair share of hoaxes, too. Remember when they said Phione was going to be in GE, then they posted a fake image of it? People were PISSED when they found out.

Seems like a pretty elaborate hoax if it is. After all, Serebii claims they got a notice as well. And I don't think pokebe... (excuse me, Pokerbeach) would have went as far out of their way as they did to make a mockery of nintendo for any other reason. (as well as the dittos. Anyone spot the Pikachu?)
 
can we even conformed it to be real or not can any one from Nintendo or TPCI talk about this at all to let people know if its real becuase I am starting to to think this is a Hoax
 
While WPM and Serebii may choose to discuss legal notices on public message boards, any Nintendo or PUI employee would probably get reprimanded or even fired for discussing internal legal matters.
They won't be posting on a message board to update third parties on what their legal department is doing.
