The games that are available on the E-Shop are

Mario Kart 7 ($40.00)
The Legend of Zelda Ocarina of Time ($40.00)
Super Mario 3D Land ($40.00)
Star Fox 64 ($40.00)
New Super Mario Brothers 2 ($40.00)

There will be more full retail downloadable games on the horizon.

About time they are getting full games on this level for DL. The DL library is small IMO. Look at how many games the GB has had in so long, and to see such a small library is lame. Glad to see the system getting more support- although I think it would be nice to see a Bronzong load of titles availible from the past, not just the 1 hit wonders.

Why can't they just put the entire GB/C/A era games on DS Download? It makes no sense. There's virtually no cost to put them there, and at even $3 a pop, they're printing monies.

^for real. Like between the original NES, the GB, the SNES, and the N64- at $3 a DL- your looking at the best thing Nntendo could do to make the 3DS the best little handheld system out there. The 3DS is amazing, it can play LOZOOT on it- just back date to the old glory days and POW! Games up the USB port! I would so love it to play OS games from the older gen systems. Come on Nintendo- get on it!

Guess I need to get 200 bucks now to get those games. The best thing about that is you keep them for life. No need to rebuy them if you lose them, just redownload them.

Honestly, I'd like to see more Virtual Console games out there. I wouldn't mind being able to have some of the games I have on my Wii's VC on my 3DS instead, such as Super Mario Bros Lost Levels.

I just wanna see FF4Adv on there. And SMRPG would be spectacular on a handheld device.

Personally, I'm waiting for the save transfer feature. My experience StreetPassing at nats/worlds was severly hampered by having to switch cards, so I'm looking forward to this.

Alright, so I am about to purchase the Mario Kart 7 game on the E-Shop. I have one question though regarding sales tax.

Say for instance I want Mario Kart 7 both $39.99. If I pay for one, will it come with tax based on my state region, and if it does, could it make the chances of me purchasing the other games impossible since the tax makes it just out of my reach?

I really hope not, and thank you for your answer!

No sales tax on the games are included on your E-shop purchase. The price shown is the price you will pay. You will need to pay the sales tax when you purchase the code card at the store, that is if your state has a sales tax on purchases.
