Pop Series 5 Legal?

I didn't think it was since it was released before D&P according to the charts I've seen but they are packaging it with D&P Booster packs. Of course they are also packaging EX boosters with 2 D&P boosters in the 3 booster pack packaging. That's kind of lame packaging stuff that will not be playable in a couple weeks but I guess it takes a while for all the stores to sell out of everything.

(This is stuff you see in Target. I buy individual cards off Ebay but had to buy some party favors for a Pokemon theme birthday party ala booster packs at Target.)
 
Those blisters are made so they get some cheap bucks on stuff they can't sell otherwise. Sad, yes, but thats how business works.
