According to English Law, if you give somebody money for one reason and they use it for any other reason (even if they then use other money for the stated purpose) then it will be Theft (can't remember the section off hand).
In terms of actually getting your money back you'll need to bring a Civil claim for the money paid.
One note though: you need to be able to prove it so collect all your evidence together and make sure it's coherent and clear!

Sorry Dan, that sucks. All I can say is, if they have small claims in England, then go with that.
