OK. I play my Wager or my opponent plays a Wager. Would a judge be able to penalize me for saying that I was going to throw rock, no matter if I did or didn't?

Depends on how it was done. There are different ways of doing RPS...there can be ways of doing it in an unsportsmanlike fashion. If it was within ordinary bounds of RPS, it shouldn't be a problem.

It can definitely be up to the judge, on whether or not someone is being unsportsmanlike (or not).
