Spiritomb and Empoleon V

Player A has 2 Empoleon V with "Emperor's Eyes," 1 in the active and 1 on the bench.

Player B plays the Spiritomb with "Fettered in Misfortune."

Currently Spiritomb is not live since Empoleon was in the Active first.
But what happens if the active Empoleon V were to be knocked out and replaced with the benched Empoleon? What if escape rope or boss was played into the benched Empoleon V?

Is the answer the same for KO, Escape Rope, and Boss or does the answer change depending on which happens?

Does who the active player is affect the answer?

There is no time when the Active position is empty, from the view of the game.
So if one Empoleon V is replaced with another, that change is instantaneous from the game's viewpoint and Emperor's Eyes remains in effect.
