[@Chairman Kaga that Epic fan art policy isn't anywhere near as open as you think. If you create a fan art site and base it upon that policy then Epic have complete control over the existance of your site if they decide to exercise the restrictions in the policy]

But they can do that anyway, the same way Nintendo just did -- with lawyers and threats.

The point is that it lays down some reasonable guidelines, other than "do it and pray our laywers don't call you". The problem with fair use as a guideline is that it isn't a guideline, it is a legal doctrine, and can only be properly judged in court. Even then, it can be applied differently from case to case. Look at Wikipedia and all the hand-wringing they have to do involving fair use of images.

I prefer to think that lawyers should be mostly unnecessary in a civilized society. There was a day when a handshake was as good as any contract. Today companies are forced to assume the most malignant intent from the most benign of actions, and then we end up with things like "PokerBeach".
 
This is pretty unfortunate, but at least I don't have to look at that ice cream cone Pokemon and its two double-scoop evolutions any longer. They were probably the worst things I had ever seen.

No because the new pokemon games are already released.

However, don't go flailing around pictures of it. ESPECIALLY not on Pokegym.
 
I got into this one late. Interesting story...

My wife and I once ran a mail order company. Our company developed cartoon-style artwork on our products that mimicked the products and salespersons for a very large company called "The Pampered Chef" or TPC for short (no relationship whatsoever to TPCi). In order to sell our products, we had a license agreement with TPC.

100% of our business was dependent upon that license agreement. Before selling any of our products, we had to get approval from TPC. They approved about 60% of our submissions. Often, when our product submissions were disapproved, there was no explanation, leaving us baffled.

Why do I relate this story? This incident baffles me.

Nevertheless, I guess when you have a direct or indirect relationship with a major, dominating party, you just do it. Sometimes, the relationship is more important than the getting answers or satisfaction. :eek:
 
Wow....just got finished reading about everything on PokeBeach. I think this really was a terrible move by Nintendo. I'm not really sure why corporations think sending cease and decist orders over such stupid things is a good idea. I'm curious to know what "damages" they think they're suffering by receiving all the free promotion they do from fansites, blogs, etc. Maybe they had to pay their workers more overtime to process the extra 5 mil in sales? There isn't going to be anything more damaging than the negative press they're going to receive, especially if anyone decides to take this story to a news station.

This reminds me of a similar fiasco a few years back with a certain retailer regarding Black Friday sales ::cough::OfficeDepot::cough:: and the outcome for said retailer. There was an online site that would post the Black Friday sale ads weeks in advance, so consumers could plan for what they would be shopping for. The site posts the ads for like, every major retail store and even some of the smaller ones. Office Depot decided it would be a good idea to send a cease and decist letter to have the ads taken down, because having them posted was going to cause "significant damages". Obviously this made perfect sense, because it would have clearly be damaging for consumers to plan to make their purchases at Office Depot on Black Friday. So to make a long story short, everyone decided to boycott shopping there. Office Depot shot themselves in the foot by "asserting their power", not only losing a large percentage of their customers on that day, but a small percentage permanently.

However, the major difference between this and the current situation with Nintendo.....Black Friday was a one day event. I know the two companies are entirely different and have completely different agendas, but the concept is still the same. The "authority figure" decides to push the little guy, hopefully they can withstand being shoved back.
 
I was considering getting B&W when it came out, but no there's no way in heck I'm going to get it. Junk like this makes me want to sell my Wii and get an Xbox. :/
 
Keep up the good work, WPM! I think Water Pokemon Master's tactics are very fun. Don't let the haters and wet blankets on the internet discourage you. Nintendo is threatening to do some not-so-nice things to harmless people. Continue to point out the absurdity of their actions.
 
I think when B/W comes out they will let up and let the pics be on the net

Nintendo needs to step aside and look how much they are hurting there product by having the pics removed
