According to pokebeach, these rules wont go into effect until after D/P are released sometime in November. By then the 3 sets rotated would be Deoxys, Emerald, and Unseen Forces. Toed ex wont be around to use anymore anyways. Polistall is still usable until rotation.

Nintendo USA never will.
Pokemon USA, on the other hand, has had them out for about 4 months now.
